The Comic Book Legal Defense Fund (CBLDF) and it coalition partners successfully challenged a decision by the online art marketplace, Redbubble, to remove a political cartoon from their website following a complaint by the Donald Trump 2020 Re-Election Campaign. Redbubble conceded that the removal was a violation of the First Amendment right to protected speech, including political satire. The Nick Anderson cartoon "The Trump Cult" was initially removed due the Trump campaign contesting that the cartoon violated trademark regulations with regards to the "Make America Great Again" (MAGA) hats used by the campaign. RELATED: President-For-Life Donald Trump Teased in Image's July/August SolicitationsThe cartoon depicted a number of Trump supporters drinking from a vat of liquid that the president is handing out samples from that was once labeled "Kool-Aid" and then "Chloroquine" and now is simply labeled "Clorox." Anderson is drawing a comparison between the Peoples Temple cult led by Jim Jones, where Jones had his supporters all drink from poisoned cups of flavored water (commonly referenced to as "Kool-Aid," although it is unclear if that specific brand was used) and the way that President Trump first advocated that people worried about the coronavirus COVID-19 pandemic try the drug Hydroxychloroquine as a preventative measure and also mused that since disinfectants wipe out the virus on surfaces, that, "And then I see the disinfectant where it knocks it out in a minute. One minute. And is there a way we can do something like that, by injection inside or almost a cleaning?" Thus, Anderson is satirically suggesting that Trump is poisoning his supporters just like Jones did. However, the Trump re-election campaign argued that it was a violation of their intellectual property rights to sell a drawing with their trademarked MAGA hats. Redbubble initially pulled the cartoon, but after the CBLDF and other groups got involved, Redbubble reversed their position. Case law, including the Supreme Court, has consistently accepted a satire exception to intellectual property rights like trademark. Redbubble issued a tweet apologizing for the removal of the cartoon.

Anderson released a statement about the issue:

I am pleased that Redbubble reversed their decision. I applaud them for this and for recognizing that it was an error.

Still, there are some troubling issues raised.The cartoon was removed less than 24 hours after I posted it. I hadn’t gotten a single order for it. I doubt anyone had even seen it yet on the Redbubble site. This reveals that the Trump campaign has a system in place, trawling for material they find objectionable. If it happened to me so quickly, it likely has happened to others. How much other content has been removed this way on Redbubble and other sites?

Also, when I received the first notice of the take down, I followed Redbubble’s instructions to protest the decision. I honestly thought the original decision was probably made by some underling, with little knowledge of copyright or trademark law, or perhaps it was even made by a bot without human eyes evaluating it. It took more than a week before Redubble responded (in contrast to the quick response for removal). I was quite surprised that Redubble didn’t reverse the decision. In fact, they doubled down and refused to reinstate the work.

It was only after the Comic Book Legal Defense Fund intervened on my behalf – and the letter written by CBLDF started getting viral attention on social media – that Redbubble reversed their decision. In the end, I recognize that Redbubble did the right thing. But it must be pointed out; the President of the United States is a hypocrite who complains about the “violation” of his free speech on Twitter, then tries to actively suppress the free speech of others. These are actions of an adolescent, wannabe-authoritarian.
