Amber Heard's attempt to have her highly publicized defamation trial with Johnny Depp dismissed has been denied.

"The motion to strike has been denied. Amber Heard will take the stand," reporter Caroline Patrickis tweeted. This news came only moments after Patrickis tweeted that Amber Heard had made an attempt to have the case dismissed.

The lengthy legal dispute between the two actors has been in the public eye for years. The situation received a resurgence in public interest following Depp's loss of his libel case against The Sun on Nov 2, 2020. The publication had previously referred to Depp as a "wife-beater," and the actor's failed suit was followed by Warner Bros. asking him to resign from his role in Fantastic Beasts: The Secrets of Dumbledore.

The current $50 million defamation suit against Heard has also claimed that Depp lost out on a $22.5 million dollar payday for not having reprised his role as Captain Jack Sparrow in a sixth Pirates of the Caribbean film. The planned sequel was canceled following Heard's 2018 Washington Post article in which she alleged Depp was abusive during their short, tumultuous marriage. This was expanded upon by Depp's agent Jack Wigham, who testified that, "After the op-ed it was impossible to get him a studio film."

This is Heard's second failed attempt to have the case dismissed. In March 2020, Fairfax County Chief Judge Bruce White blocked the star's move to strike down the trial in Virginia.

With the most recent denial of her motion to dismiss, Heard is now set to once more take the stand in a trial that has seen multiple unexpected developments. Most recently, Heard fired her PR team at Precision Strategies in favor of placing consulting firm Shane Communications on retainer in a bid to combat what the actor allegedly perceived as negative headlines in the press.

Heard will next appear on-screen in Aquaman and the Lost Kingdom, due in theaters in March 2023.
